How do we know which atemoya is patented and which patent is expire?

There are no recent patents for cherimoya nor atemoya trees in US.
The Australian have Plant Breeders Rights.
Pink Mammoth and Hillary White would be expired if translate to US Patent 20 years lifetime.

I want to understand the ramifications of the Australian’s Plant Breeder Rights on USA laws or international laws.  How does one protect one’s intellectual properties such as Cotton Candy?  How do we know if we are violating the law?

There are only 2 entries for custard apple in Australian Plant Breeders Rights.
KJ Pinks expires in 2 years.
Pinksblush expires in 17 years.
